Supreme Court already ruled Senate quorum of 12 is legal, says lawyer | DZMM TeleRadyo

Описание: Wednesday’s Senate shakeup that led to the installation of Sen. Win Gatchalian as the Acting Senate President despite a quorum of only 12 senators is legal based on the Avelino v. Cuenco Supreme Court doctrine, according to Atty. Melencio Sta. Maria.

Sta. Maria said the 1949 SC decision ruled that the actual count for a quorum only includes available and functional senators.

The SC decision was used by then Senate President Franklin Drilon to declare a quorum of only 12 senators in 2015, after 3 senators - Juan Ponce Enrile, Jinggoy Estrada and Bong Revilla - were incarcerated on plunder charges, while 4 others were overseas. Senators Alan Peter and Pia Cayetano, and Loren Legarda took part in the 2015 Senate quorum.
