You sued your doctor for malpractice.
You believe he was careless and caused you significant harm and injury.
Your doctor denies all of your allegations.

Your doctor says he did nothing wrong.
He also claims that whatever he did, did NOT cause you injury.
Then he argues that IF he did something wrong, then whatever harm you suffered is not that bad.

You know in your heart of hearts that he screwed up.
You know you have a valid case.
You know a medical expert has reviewed your records and confirms your doctor violated the basic standards of medical care and that wrongdoing caused you injury.
You also know that you'll never be the same again.

During your case, it becomes obvious that the doctor was negligent.
While questioning the doctor, it's clear that he violated the standard of care.
While he won't admit he screwed up, it's clear from my hypothetical questions that IF our version of the facts are to be believed (and you are a very credible witness) that his actions would have violated the standard of care.

Everybody in the doctor's deposition realizes this.
Now, at the end of the doctor's deposition, after the doctor has left the room, I turn to the defense lawyer and say "Do me a favor...reach out to the carrier and let's see what we can do here."
