Can India's Chief Election Commissioner be outvoted by the other Election Commissioners? Short answer: yes.
In under two minutes:
• Article 324(1) vests election powers in the Election COMMISSION, not a single Commissioner
• Clauses (2), (3) and (5): the Commission's composition, the CEC as Chairman, and stronger removal protection for the CEC
• S.S. Dhanoa v. Union of India (1991): abolition of two Election Commissioner posts upheld
• T.N. Seshan v. Union of India (1995): the multi-member Commission upheld; the other commissioners must have a meaningful role
• Section 18 of the 2023 Act: unanimity where possible, majority decision when members disagree
Takeaway: the CEC chairs the Commission, but the majority prevails.
