Because now contract employees can receive gratuity after just 1 year of service.
This change comes from the Code on Social Security, 2020,
which is being implemented across sectors.
Earlier, gratuity was only available to permanent employees,
and only after 5 years of continuous service.
Many companies used this loophole.
They hired people on short-term or contract roles
just to avoid paying gratuity.
But the rule has changed.
Now if you are on a fixed-term or contract job
and you complete 1 year of service,
the company must pay gratuity.
They cannot deny it.
Example:
If your monthly salary is ₹50,000
and your contract lasts 2 years,
you could receive around ₹57,692 as gratuity.
So here’s what you should do:
• Check your contract letter
• Note your joining date
• Verify your last drawn salary
And when you leave the company,
ask HR for your gratuity claim.
If it is denied,
you can file a complaint with the Labour Commissioner or Labour Court.
