Aaron Spencer, 36, is charged with M in the Second Degree, a Class A Felony
in violation of ACA §5-10-103 and Felony with a Firearm, in violation of ACA §16-90-120 in connection with the October 8, 2024 death of Michael Fosler. Fosler, 67, had previously been charged with 43 felonies for crimes committed in June 2024 against Spencer's 13 year old daughter, and was released on $5,000 cash bail and a stay away order, and on 9/4/24 the charges against Fosler were sealed. Fosler's trial was scheduled for December 4-6, 2024. On the evening in question (10/8/24) Aaron Spencer & his wife awoke to find their daughter missing. Spencer left the house to look for her and came upon Fosler's truck - and his daughter in the passenger seat! The scene ended with Fosler's demise, but Spencer saved his daughter's life. Charges were brought against Spencer in Lonoke County by the DA on November 27, 2024, and by December 10, 2024, Judge Barbara Elmore issued an unconstitutional gag order in the case, preventing the defendant, attorneys, law enforcement and potential witnesses from speaking about the case, and sealed the entire court file. The Arkansas Supreme Court reversed, but the gag order was not vacated until JUNE 20, 2025. A pre-trial hearing is scheduled for 8/8/25, and the trial is set for Sept 22-26, 2025. Important to note, Judge Elmore is the same judge who released Fosler on a paltry bond, and it has been reported that Fosler had previously been a Police Chief in Indiana. Spencer's attorneys have indicated the he will use Justification as a Defense.
