As I was driving home after being unlawfully trespassed from Blue Spring State Park I received a phone call from Captain Maxwell Edson of the Florida Fish and Wildlife Conservation Commission. Less than 2 hours after being trespassed Captain Edson informed me that the trespass was being rescinded. Captain Edson also sent me the following email.

Mr. Gray

As discussed, the trespass warning issued to you on November 19, 2025 in Blue Springs State Park has been fully removed from our system. After conducting a supervisory review of the incident, it was determined that our officers were contacted by park staff to investigate a potential violation of Florida Administrative Code 62D-2.014(18). Enforcement actions related to this administrative code, in its current form, are not consistent with the enforcement philosophy of the Florida Fish and Wildlife Conservation Commission’s Division of Law Enforcement. Therefore, any trespass warning resulting from an investigation under this code is considered null and void.

Why Panhandling is Free Speech

Content-Based vs. Content-Neutral: Regulations that target the specific content of the speech (e.g., arguing against panhandling based on the message of requesting money) face strict scrutiny and unconstitutional.
