The Government of India recently introduced e-commerce rules under the Consumer Protection Act, which contain sweeping changes for both Indian and foreign businesses. Most importantly, these rules mandate an Indian local presence requirement for foreign e-commerce entities operating in India. Such a local presence requirement will not only subject foreign companies to Indian laws but will also trigger payment of Indian taxes.
In addition, there are significant disclosure obligations for all types of e-commerce entities as well as sellers, strong grievance redressal requirements, and a variety of proactive compliance measures. Until the recent past, the consumer protection regime in India was reactive, based on consumer complaints, however, this new regime is a regulator-based framework with ongoing compliance.
