Описание: In a significant matrimonial ruling, the Andhra Pradesh High Court reiterated that the convenience of the wife must be prioritised over the inconvenience of the husband while deciding transfer petitions.

Justice V. Gopala Krishna Rao allowed the wife’s plea to transfer the divorce proceedings filed by the husband from Repalle (Guntur District) to the Family Court at Ongole (Prakasam District).

The wife argued that she lives in Ongole with her two school-going children and travelling more than 100 km for every hearing without male assistance was extremely difficult. The husband opposed, claiming she wanted to delay the matter and that he had job commitments in Hyderabad.

The Court noted that the husband’s personal appearance can be exempted when not legally required and found justifiable grounds to shift the case. Since the divorce petition had been pending for over five years, the Family Court, Ongole, was directed to dispose of it within four months.
