GTX 970 using 3.5GB + 500MB VRAM while playing Shadow of Mordor at 2k maxed out

As many of you have heard the GTX 970 has gotten a lot of heat because of the memory allocation. It uses 3.5GB and the other 500MB only when it's necessary. This has gotten a lot of buzz and is justified.
What is not justified is the trash talk about it making games stutter when it actually is using more than 3.5GB VRAM.
In practice the 500MB section doesn't make anything stutter or cause lag spikes.
Some variables are showing incorrectly only because of a conflict between shadowplay and MSI overlay. GPU, MEM frequencies are off, the voltage and VRAM.
However the VRAM for those of you who have the game and/or have seen benchmarks know that at 2k maxed out it reaches 3.8-3.9GB very fast.
