The grant of leave to defend (with or without conditions) is the ordinary rule; and denial of leave to defend is an exception, the Supreme Court observed in B.L. Kashyap And Sons Ltd. Vs JMS Steels And Power Corporation in which it discussed the scope of Rule 3 of Order XXXVII of the Code of Civil Procedure 1908.
सुप्रीम कोर्ट ने बी. एल. कश्यप एंड सन्स लिमिटेड बनाम जेएमएस स्टील एंड पावर कॉरपोरेशन में कहा है कि बचाव के लिए अनुमति देना (सशर्त या बिना शर्त) सामान्य नियम है; और बचाव के लिए अनुमति का इनकार एक अपवाद है। कोर्ट ने संबंधित फैसले में नागरिक प्रक्रिया संहिता (सीपीसी) 1908 के आदेश XXXVII के नियम 3 के दायरे पर चर्चा की है।
