Driver's License and Admin Per Se in Arizona DUI Cases

Описание: The most time sensitive issue when being charged with a DUI is dealing with the Motor Vehicle Department.

If you don’t act quickly, you may lose your chance to keep your license.

When a person is charged with DUI, documents are filed in two locations.

The criminal charges are filed with the Court but a separate document known as an Admin Per Se is filed with the MVD, or the Motor Vehicle Department.

This is a yellow or pink piece of paper that looks like this.

This document goes to the MVD and addresses the validity of your license and all of your driving privileges.

When you look at this form, you will see 2 separate boxes near the bottom that describe the terms of the proposed license suspension.

The top box will be checked if there was a refusal to provide a blood or breath sample to the police and they had to get a warrant.

If this happens, the MVD will impose a 12-month suspension on your license.

The bottom box is checked if there was no refusal but the police believe you were impaired.

In this case, the MVD will impose a 90 day suspension which is broken into a total suspension for the first 30 days and a restricted license for the remaining 60 days.

The reason this is so time sensitive is because these suspensions will go into effect automatically – unless you request a hearing to challenge these orders.

There are only 15 days from the time you receive this document to request that hearing.

If no request is made, you lose the right to contest the license suspension entirely.
