Under Penal Code 422 PC, the crime of "criminal threats" occurs when you make threats to kill or injure a person, or the person's family, with the intent to put the person in fear, and the person actually does become in what the law calls "sustained fear."
Criminal threats is a wobbler per Penal Code 422 PC, meaning it can be prosecuted as a felony or a misdemeanor. As a felony, it carries a potential prison sentence of up to 3 years in jail or prison. As well, it counts as a strike under California's three strikes law.
