In an unprecedented move, the United States Supreme Court recently granted certiorari in the case of Reynaldo Gonzalez, et al., v. Google LLC. This case marks the first time in recent memory that the Supreme Court has agreed to review the seemingly limitless immunity granted to online service providers pursuant to Section 230 (c)(1) of the Communications Decency Act.
This case asks the simple question of whether recommendations made via online service providers' unique algorithms go beyond the scope of traditional editorial functions, which are covered under the protection of Section 230, and whether such recommendations are instead a form of actionable speech by the online providers themselves.
