I'm happy to share the two sample letters to request an Independent Education Evaluation. Just leave a comment below, I'll be in touch and I can email the letters to you!
Have you ever disagreed with an evaluation the District has done, or has your District ever not conducted a complete evaluation of your child? You going to learn what to do about this today.
Parents have a right to ask for an Independent Education Evaluation (IEE)
Districts only have 2 choices after they’ve received your request: 1) they can grant your request and pay for the evaluation or 2) they can file for a due process hearing to show their evaluation was appropriate.
when a parent makes a written request for an IEE, you want to make it short and sweet, well at least short.
“We request an Independent Education Evaluation (IEE) for our son/daughter (child’s full name) for a Functional Behavioral Assessment. It is our understanding the District must ensure the IEE is provided at public expense or initiate a due process hearing. Which of these two courses of action is the District electing to do?
We look forward to your response so there is no unnecessary delay.”
What about if the District failed to conduct a complete evaluation and the parents ask for an IEE?
If the District failed to conduct an evaluation in a certain area then I suggest parents send this type of letter or email:
Thank you for email concerning our request for an Independent Education Evaluation (IEE) for our son Beckham. It is our understanding the District must ensure the IEE is provided at public expense or initiate a due process hearing. This is clarified in the Office of Special Education Programs letter dated Feb. 23, 2015, "When an evaluation is conducted in accordance with 34 CFR §§300.304 through 300.311 and a parent disagrees with the evaluation because a child was not assessed in a particular area, the parent has the right to request an IEE to assess the child in that area to determine whether the child has a disability and the nature and extent of the special education and related services that child needs."
Is the District electing to provide the IEE at public expense, or initiate a due process hearing?
We look forward to your response so there is no unnecessary delay.
