The Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021, prohibits religious conversion through unlawful means such as misrepresentation, force, fraud, undue influence, coercion, allurement, or marriage. It was enacted to replace an ordinance promulgated in November 2020.
The law, which is often referred to as the "love jihad" law by the media, has faced significant legal and constitutional challenges. In July 2024, the state legislature passed amendments to make the law even more stringent.
Key provisions of the Act
Prohibition of unlawful conversion: The law criminalizes and bans religious conversion by various unlawful means, including marriage. However, reconversion to one's immediate previous religion is not considered a conversion under this Act.
Marriage for conversion declared void: Marriages performed solely for the purpose of unlawful conversion can be declared null and void by a family court.
Notice period for conversion: For a legal conversion, a person must provide a declaration to the District Magistrate at least 60 days in advance, stating that the conversion is voluntary. The religious converter performing the ceremony must also give a one-month advance notice.
Cognizable and non-bailable offense: Offences under the Act are cognizable, meaning police can make an arrest without a warrant, and non-bailable.
