M.K. STALIN’S MISA ARREST: WHAT DO THE SHAH & ISMAIL COMMISSION REPORTS ACTUALLY SAY? | ADVOCATE VARDHINI
During the Emergency (1975–1977), thousands of people were detained across India under MISA. M.K. Stalin has repeatedly spoken about his detention and the physical assault he suffered while in prison.
But what do the official Commission reports actually record?
In this video, we examine the Shah Commission of Inquiry Report and the Justice M.M. Ismail Commission Report, and look specifically at what they say — and do not say — about M.K. Stalin.
One important point examined in this video is that M.K. Stalin’s name does not appear in the Shah Commission Report. However, the Shah Commission was not simply a complete name-by-name register of every person detained during the Emergency. Therefore, the absence of a person’s name from the report by itself cannot conclusively establish that the person was not detained.
We also examine the Ismail Commission, which was constituted in Tamil Nadu to inquire into allegations of ill-treatment of prisoners in Madras Central Prison during the Emergency period. The Commission found that MISA detainees had been subjected to torture, ill-treatment and harassment. (Indian Kanoon)
So the real question is:
What do the original records establish about M.K. Stalin’s arrest, the legal basis of his detention, and the events inside prison?
This video separates documented facts, Commission findings and political claims so that viewers can examine the historical record for themselves.
DISCLAIMER
This video is intended for historical, political and educational discussion based on publicly available records, Commission reports, contemporary accounts and other historical sources.
The video does not intend to defame, malign or make any unverified personal allegation against M.K. Stalin or any other individual.
Where the video discusses the absence of M.K. Stalin’s name from the Shah Commission Report, that observation refers specifically to the records examined for this video. The absence of a name from a Commission report should not, by itself, be treated as conclusive proof that an individual was not detained.
The purpose of this video is to examine the documentary record concerning the Emergency, MISA detentions, the Shah Commission and the Ismail Commission, and to distinguish documented findings from political claims or interpretations.
Viewers are encouraged to examine the original reports and historical records independently.
