In the major ruling, Catholic Charities Bureau, Inc., et al. v. Wisconsin Labor and Industry Review Commission et al., the Supreme Court addressed a key dispute over a state unemployment compensation tax exemption. The Petitioners, Catholic Charities Bureau and its subentities, were denied this exemption by Wisconsin courts. Wisconsin law exempts nonprofits operated primarily for religious purposes and controlled by a church. The state court decided the Catholic Charities did not qualify. This was because the charities neither engaged in proselytization nor limited their charitable services to only Catholics. The Supreme Court ruled that this application of the law violates the First Amendment. The decision found that the state imposed unconstitutional denominational discrimination. This occurred because the state was differentiating between religions based on their theological choices and practices. The government must maintain strict neutrality between religions. Because the state failed to justify this discrimination under the required legal standard of strict scrutiny, the Supreme Court reversed the denial of the unemployment tax exemption.
