When Does Accountability Begin? | Signs of Puberty in Islam

In today’s lesson from the Fiqh Series, we study a foundational topic in Islamic law: the signs of puberty.

Puberty is extremely important in fiqh because it marks the moment a person becomes legally accountable (mukallaf) before Allah. Before puberty, a child is not obligated to perform acts of worship. Once puberty occurs, obligations such as prayer, fasting, and other religious duties become mandatory.

The Prophet ﷺ said:

“The pen has been lifted from three: from the sleeping person until he awakens, from the child until he reaches puberty, and from the insane until he regains sanity.”
(Sunan Abī Dāwūd, Tirmidhī)

This hadith establishes that legal responsibility begins at puberty.

In the text Safīnat al-Najāh, the scholars explain that the signs of puberty are three:

1. Reaching the age of 15 lunar years for both males and females.

Evidence comes from the narration of ʿAbdullāh ibn ʿUmar (رضي الله عنه) who said:

“I was presented to the Prophet ﷺ on the day of Uhud when I was fourteen, and he did not permit me to fight. Then I was presented to him on the day of Khandaq when I was fifteen, and he permitted me.”
(Ṣaḥīḥ al-Bukhārī, Ṣaḥīḥ Muslim). The scholars derived from this that 15 lunar years establishes adulthood if no other signs appear.

2. Experiencing sexual emission (a wet dream) after the age of nine for both males and females.

Allah mentions this in the Qur’an: “When the children among you reach puberty (al-ḥulm), let them ask permission…” (Surah An-Nūr 24:59). The word ḥulm refers to reaching sexual maturity.

3. Menstruation for girls after the age of nine.

Menstruation is recognized as a clear biological sign of maturity and legal responsibility in Islamic law. The Prophet ﷺ also referred to menstruation as something Allah has decreed upon women when he said to ʿĀʾishah (رضي الله عنها):

“This is something Allah has written upon the daughters of Adam.”
(Ṣaḥīḥ al-Bukhārī)

Once one of these signs appears, a Muslim becomes mukallaf, meaning they are now responsible for fulfilling the commands of Allah and avoiding what He has prohibited. Understanding this topic is essential because many rulings in fiqh depend on when legal responsibility begins.
