Buchanan lost the contest against Prime Minister, Dr. Andrew Holness, falling 2,110 votes short on election night, September 3.

Justice Sonia Wint-Blair ruled on Monday that the application by Buchanan's attorney Hugh Wildman was not arguable and was subjected to a "knock-out blow" in the law.
