Over the years, Lemberg Law clients have told us some crazy stories of debt collection abuse. But just when we think we’ve heard everything, we’ll read about a debt collector that’s gone more extreme.

Here are five debt collection tactics that really cross the line.

1. Trying to collect from relatives of the deceased. Some debt collection agencies specialize in “deceased debt,” and try and collect from surviving relatives. The truth is that, unless the person was married or someone co-signed on a loan, their debt dies with them.

Debt collectors can contact the person handling an estate, but the rest of the relatives are off-limits.

2. Failing to notify you that you’re being sued. This is called “gutter service,” and it works like this. If a debt collection agency sues you, you’re supposed to be notified so you can appear in court. But some debt collectors tell the court that they’ve served you papers when they just throw them away. When you don’t show up to defend yourself, the court grants summary judgment to the debt collector. And then your wages get garnished.

Some states, New York included, have tried to put a stop to this by notifying consumers themselves.

3. Tracking you down on social media. Sometimes a debt collector will use a fake identity to try and connect with you on social media. Sometimes they go even further, and post about your debt on your social media account, or try and contact your Facebook friends. It’s illegal for a debt collector to pretend to be someone they’re not or to tell another person about your debt. But that doesn’t stop them.

4. Intimidating servicemembers. There have been too many instances where debt collectors target our men and women in uniform. They’ll call their commanders or say that they’ll be court martialed.

5. Misrepresenting legal proceedings. Debt collection agencies can’t send consumers documents that appear to be from a court when they’re not. There was a debt collection agency in Pennsylvania that actually set up a fake courtroom to try and intimidate consumers.

This is really the tip of the iceberg. Debt collection agencies violate the Fair Debt Collection Practices Act when they

1. Repeatedly call you or harass you
2. Threaten you with lawsuits
3. Fail to tell you they are debt collectors
4. Call you at work after you tell them not to
5. Talk to others about your debt
6. Lie to you
