So you may have already heard, but recently Nintendo filed a lawsuit against Tropic Haze LLC, the developer group behind the popular Switch emulator, Yuzu.

This lawsuit was filed in the District Court of Rhode Island and Nintendo claims that Yuzu "unlawfully circumvents the technological measures on Nintendo Switch games."
Now, if you're familiar with video game emulators then you likely already know they are legal and in most cases, are protected under fair use. That's true if the developers of the emulator reverse engineered the code. However, there are a couple of interesting details that Nintendo hopes to leverage for a court win, here.
Firstly, the company claims that Yuzu's ability to break the layers of encryption included in their games is against the laws provided in the Digital Millennium Copyright Act.
If you have used Yuzu before, then you already know that the emulator itself doesn't decrypt these games. That is only possible after the user has added the title.keys file and prod.keys file.
Without those, the Yuzu emulator isn't able to play any Switch games. No matter if those games were downloaded illegally online or backed up legally with a physical copy that someone owns.
So while Nintendo cannot claim that Yuzu is breaking this software protection, they do, in multiple instances, reference the Quickstart Guide that is up on the Yuzu website.
And while Yuzu doesn't tell you to go and break the law by downloading those decryption keys. They do provide links to a number of tools that will assist you in extracting those from your older Nintendo Switch console.
This is really the crux of the lawsuit right here. Nintendo claims that the developers behind Yuzu clearly know that using the emulator breaks DMCA law due to the use of those decryption keys.
While not relevant to the specific details of the lawsuit, Nintendo goes on to say they themselves have the right to decide whether they want to bring their games to other platforms or not. They would also like to believe that when you go out and buy a game for the Nintendo Switch. . .you are only authorized to legally play that game on an unmodified Switch console. Claiming that any other copy, even a legal backup of the game, is an unauthorized copy.
So the next question is, where does this case go from here.
We have yet to hear a response from the folks behind Tropic Haze LLC. . .aka the developers of Yuzu. Sadly, this could end with them not wanting to take the chance and simply settle out of court. We know that Nintendo would like that very much, as that would allow them to win this fight without ever speaking to a jury member.
And I would assume this is what most hobbyist developers would end up doing. That could result in the website, discord, GitHub and patreon page being shut down immediately.
But it's possible that the people behind Tropic Haze LLC have been saving the funds that have been donated via Patreon. It's possible that they have been preparing for this exact situation. I do hope that they understand Nintendo isn't picking a fight with emulators themselves with this lawsuit.
Instead, they're attacking the tools and techniques used that allow Nintendo Switch emulation to actually work. So even if they aren't able to get the Yuzu emulator taken down, they could cause a break in the chain that gamers are using to play their own Switch backups.
As always, this court case will be used as precedent going forward in other video game emulation lawsuits. Because you know this won't be the last one. So this is a case that I'll be actively watching as it progresses and I hope you all will be as well.
