And today I'd like to share with you another episode of what I call case or no case. And in these series of videos, I tell you a little story about a medical malpractice case and then discuss whether or not it's a case or not a case.

So here's today's story.
Suppose we have a young woman that goes to the hospital, she's very excited to deliver her baby. And during the course of the delivery, there's a complication, the baby seems to be stuck, the baby is not coming out and the doctors and the nurses rush in and there seems to be a lot of stress and a lot of panic in the room and there's concern that the baby is stuck and therefore that the baby may not be getting the appropriate oxygen. And the doctors and nurses, they decide that they're gonna pull this baby out. And when they bring the baby to this woman, they tell her, well, we have a complication. Your baby has a permanent paralysis of the neck endowed into the arm and it's called herb's palsy or racial plexus palsy. And now this woman is being given medical terms, she doesn't know what they even mean. And she's thinking to herself, well, was this caused by a medical mistake at birth? And let's suppose that the baby goes on and that never goes away and the baby is not able to use his or her arm. Normally can't raise the arm above the head, can't grasp things really has a paralyzed and very severely deformed. That's gonna be there forever. So, is that a case or no case?
