I deal with trusts after someone passes away — when the documents actually have to work.
And here’s the hard truth:
Most revocable trusts aren’t the problem.
Incomplete revocable trusts are.
Here’s what I see over and over:
• Beautiful 40-page trust documents
• Clients told they’ll “avoid probate”
• Assets never properly transferred into the trust
• Houses still in individual name
• Bank accounts never retitled
• Brokerage accounts misaligned
• Beneficiary designations contradicting the trust
Then the person dies.
And the beneficiaries are left paying thousands — sometimes tens of thousands — to untangle the mess.
A revocable trust is just a container.
If you don’t fund it, it’s empty.
If you don’t align your assets, it fails.
If you overcomplicate it, your family pays.
From a practitioner’s perspective, I favor the KISS principle:
Keep It Simple.
Clear beneficiary designations.
Properly recorded deeds.
Aligned assets.
Straightforward documents that are actually maintained.
Trusts absolutely have their place — blended families, privacy, special needs planning, out-of-state property.
But selling a complicated trust package to everyone is not planning.
It’s paperwork.
The real question isn’t “Do you have a trust?”
The real question is:
👉 Is it fully funded?
👉 Is it aligned with your assets?
👉 Will it actually work when your family needs it?
Because when it doesn’t — your beneficiaries are the ones writing checks to lawyers.
