5 Things to Not Say to the Insurance Adjuster

After you’ve been injured in a wreck, you’re likely to be contacted by an insurance adjuster who will want to discuss your case with you. But you need to be cautious: In North Carolina, you can have your whole claim denied if you’re determined to be even one percent at fault due to the doctrine of contributory negligence.
Here are five things you generally want to avoid saying to the at-fault driver’s insurance adjuster:
(0:43) “They came out of nowhere.”
This can imply to the insurance adjuster that you weren’t paying attention and are thus at fault.
(1:00) “They had to have been speeding.”
This can imply that you perceived your surroundings and saw the danger but made an improper decision anyway, making you partly at fault as well.
(1:17) “Next thing I knew, they hit me.”
The adjuster may interpret this to mean that you saw the other party and could have avoided them but didn’t.
(1:44) “The light turned green and I pulled off.”
This one’s tricky because green means go, but it’s still your duty to check your surroundings before entering an intersection. You don’t want to give the impression that you weren’t looking when you drove off.
2:02 – “I was coming from a friend’s house.”
Don’t fill in the details if you can’t remember. If you were coming from somewhere else and the adjuster discovers this, you’ve raised red flags needlessly.
