BATAVIA POLICE RELEASE INFORMATION ON MANHUNT
SUBJECT OF NEWS RELEASE: Burglary 28 Park Ave. Batavia NY

LOCATION: 28 Park Ave. Batavia NY
At 11:28 AM the Batavia Police were dispatched to 28 Park Ave. for the report of two persons entering a rear door. Additionally the neighbor reported seeing two males at the front door of 28 Park Ave. appearing to be ringing the doorbell about ten minutes before hearing a crashing noise and seeing them enter the rear door.
Several officers from the Batavia Police, Genesee County Sheriffs and NY State Police, converged on the scene setting a perimeter. First officers reported two black males wearing black clothes and black hoodies running out the back door.
Foot pursuit was initiated one suspect fled to the east and one two the west. The individual who was later identified as Nathaniel Davis 18 years of age, address unconfirmed, was apprehended 100 yards from the burglarized house. Once in custody a frisk search incident to arrest was conducted and a loaded hand gun was found in his possession.
The second individual fleeing west was actively pursued and the police were confident he could not have gotten out of the perimeter that was quickly set at the beginning of the incident. NYS Police Helicopter was promptly on scene and observed the perimeter from the air.
Genesee County Sheriffs K-9 Officer Thompson responded off duty and was able to start a track. Multi agency Officers continued to close on the suspect with the help of neighborhood spotting. Deputy Thompson and K9 alerted on the suspect at 48 Ellicott Ave where he tried to continue to evade officers. He was taken into custody. He was positively identified as one of the persons running from the burglarized home. His identity was determined to be Akeem Simmons, 23 yoa a parole absconder.
At the present time both are being questioned. Possible charge for both is Burglary 1st a class B Felony.
Note: St. Paul's school decided to put themselves in lockdown during the incident after speaking with officers in the neighborhood.
If the incident was to last much longer all other City Schools would have been placed in lockdown also according to Police Chief Heubusch.
Detective Schauf said both suspects will be facing burglary 1st charges, other charges will also include criminal possession of a weapon, criminal mischief and resisting arrest.
