The ongoing prosecution of James Flynn has become a national disgrace, exposing the extent to which the justice system will go to preserve its own narrative—no matter how deeply flawed.

Re-trial Ordered Despite Full Acquittal

James Flynn, who had previously been fully acquitted of all charges related to the Lordship Credit Union robbery and murder, has now been ordered to stand trial once again—including for offences of which he has already been found not guilty. This represents an outrageous violation of the principle of double jeopardy, which protects individuals from being tried twice for the same offence. This decision sets a chilling precedent and raises serious concerns about the rule of law.

Bail Denied – Prosecution Not Prepared

To compound this travesty, James Flynn was refused bail simply because the prosecution were not ready. As a result, he remains unlawfully imprisoned today. The court’s inability to justify a legal reason to hold him further underscores the farcical nature of this entire process.

Fabricated Evidence and Contradictions

The state’s claim continues to rely on a blue Passat allegedly stolen in Clogherhead and supposedly used in the robbery. However, eyewitnesses consistently stated that the vehicle involved was a grey or silver Passat. There is no forensic or credible link between the blue vehicle and the murder or robbery. This manufactured connection forms the foundation of what can only be called a deliberate attempt to mislead the court and the public.

Judicial U-turn: From Misconduct to ‘Mistake’

We have now seen the judiciary whitewash Judge Tony Hunt’s misconduct by reducing what was previously acknowledged as an unlawful act to nothing more than a ‘mistake’. This deliberate reframing is nothing short of a cover-up designed to protect senior officials and to push forward a case that never should have been brought to trial in the first place.

A Clear Abuse of Power

Let us be clear: James Flynn is being tried again for crimes of which he has already been acquitted. This is not only unjust, it is deeply unlawful. The only ‘evidence’ presented contradicts all original eyewitness testimony. What we are witnessing is a desperate attempt by the state to justify a flawed prosecution—at any cost.
