Synopsis: Our client was driving home. He has left work and got some food at the gaslight festival. He consumed no alcohol that day. On his way home, he picked up his friend who had been drinking and had an open container, which he brought with him to our client's car.

A few miles before he got to the house, police pull him over for speeding. The two cops smell the alcohol on his FRIEND'S breath and in the car due to the open container, and realize they might have scored an easy DUI (since our client has a prior, so chances are he'll plea guilty anyway).

He refuses their roadside tests and the breathalyzer at the station.

The prosecution claimed to have a signed implied consent form, calibration records for the radar used in the stop and some other documents that they never brought to court.
