Section 31 explains a very important principle of criminal law: when an act is done with the consent of a person and in good faith, it is not considered a crime. The law respects the right of individuals to make decisions for themselves, especially when the act is intended for their own benefit.
For example, when a patient knowingly gives permission to a doctor for a surgery, or when two players agree to play a contact sport like boxing or wrestling, the resulting injuries will not be treated as offences under law. This is because the consent was given voluntarily, without fraud or coercion, and the act was performed in good faith.
However, this protection is valid only if:
Consent is free and informed, not obtained by fraud or force.
The act is genuinely for the benefit of the consenting person.
The act is performed in good faith and not with an intention to cause harm.
This section ensures that Indian law balances personal autonomy with legal protection, giving people the right to consent for actions affecting their own body or interest, provided there is honesty and fairness.
