In California, the age of consent is 18 years and if one has unlawful sex with a minor, he or she can be prosecuted for a felony and face jail or California state prison. Sex is defined as any penetration, no matter how slight. However, it is a defense to this crime if you honestly and reasonably believed the "victim" was an adult. A conviction under Penal Code 261.5 generally does not require one to register as a sex offender.
