🚨 Big Ruling! Res Judicata Applies in Criminal Cases Too – SC Clears the Confusion!
In a powerful judgment in S.C. Garg v. State of Uttar Pradesh (2025 SC), the Supreme Court has held that the principle of res judicata is applicable even to criminal proceedings.
This means that findings of fact recorded in one criminal case can bind the parties in any subsequent case involving the same issue.
The Court addressed the confusion between two earlier lines of judgments:
✅ One supporting res judicata in criminal trials (e.g. Pritam Singh, Bhagat Ram)
❌ Another denying its application in cases dismissed at pre-trial stages (e.g. Devendra, Muskan Enterprises)
