In this video, I'll explain "What is Summary Probate?" and why it's not a process available in California. As a practicing attorney in California, I frequently encounter questions about different probate processes, including summary probate. Probate can be a complex topic, and many people are surprised to learn that California does not have a specific process called "summary probate." Instead, we use the general probate process to handle estate administration.
So, what exactly is summary probate? In some states, summary probate is a streamlined process used to settle smaller estates quickly and with less expense than traditional probate. It’s designed for estates that fall below a certain value threshold, usually when there aren’t complex assets involved or when the deceased left clear instructions in a will. Essentially, summary probate allows heirs to bypass the lengthy court procedures of traditional probate, reducing both time and legal costs. For example, some states use summary probate when an estate's total value is below a particular amount, such as $50,000. This process involves filing fewer documents with the court, possibly avoiding formal hearings, and distributing assets more efficiently.
However, in California, we do not have summary probate. The California probate system is structured with only one probate process for all estates, regardless of size. That said, California does offer other alternatives to the traditional probate process, such as using affidavits for small estates and filing for spousal property petitions, which can make estate distribution more manageable for smaller estates. These alternatives are sometimes confused with summary probate because they streamline parts of the probate process, but they are not the same.
In California, when someone passes away with assets exceeding $184,500 (as of the current threshold), the estate typically needs to go through formal probate. The process can be time-consuming, often taking several months to over a year, depending on the complexity of the estate. California probate involves filing a petition with the court, notifying heirs, appraising assets, paying debts and taxes, and finally distributing the remaining assets to the rightful heirs.
For smaller estates in California—those worth less than $184,500—there are simplified procedures available. One such option is the "Small Estate Affidavit," which allows heirs to collect assets without formal probate if certain conditions are met. Additionally, the "Spousal Property Petition" allows a surviving spouse to bypass some of the more cumbersome aspects of probate. While these options are more streamlined than traditional probate, they are not summary probate in the strict sense that other states use.
