Republican AGs vs. Trump DOJ: The Cannabis Civil War

Описание: Three Republican attorneys general just sued Donald Trump's own DOJ to kill marijuana rescheduling. Bill Barr is their lawyer. They think they're fighting a cannabis case. They're not. They're handing Trump a crowbar.

Acting AG Todd Blanche signed the order moving medical marijuana from Schedule One to Schedule Three — no notice, no comment period, no public input. Nebraska, Indiana, and Louisiana say that violates the Administrative Procedure Act. Case 26-1106 is now live in the D.C. Circuit.Here's what this case is actually about.Trump's legal team is arguing the 1961 Single Convention on Narcotic Drugs gives the executive branch authority to bypass the APA entirely under Section 811(d)(1) of the Controlled Substances Act.

The D.C. Circuit now has to pick a lane.If Trump wins: The treaty pathway survives the APA challenge. The executive can reschedule anything by order. Trump becomes the president who freed the flower and rewrote how executive power interacts with federal administrative law.If Trump loses: The D.C. Circuit rules that domestic law overrules treaty obligations. Not just the Single Convention — every treaty on the books. France and Germany can no longer point to NATO treaty language as a guarantee of US commitment.

Either they hit their defense spending targets, or they explain to their voters why the treaty text they've been hiding behind just got ruled unenforceable in a US federal court.The prohibitionists think they're stopping cannabis reform. They may be building Trump's most powerful card in international relations.Trump can't lose.
