Former Virginia Secretary of State and current Senior Fellow with the Center for Renewing America, Ken Cuccinelli, joins to tell us how he sees this playing out. Cuccinelli shares who has the right of way and whether there is a solution when diving into the notion of state's rights vs the federal government's rights. Governor Abbott said in an interview that if this case is re-litigated, the Fifth Circuit Court of Appeals would side with the state over the federal government. Cuccinelli discusses whether he thinks that is true and what new argument Texas would make to get a ruling in its favor. Abbott is clearly frustrated with the Biden Administration's handling of immigration issues, but on Capitol Hill, Republicans are refusing to vote for the bipartisan border bill, calling it an "election year compromise". Cuccinelli explains what his assessment is of this strategy and whether he really thinks a better deal can be struck in a year's time.
