The Minister for Justice has said that he has no power to keep convicted rapist Larry Murphy behind bars.
Murphy is expected to be set free from Arbour Hill prison sometime in the next 24 hours.
The former carpenter from Baltinglass in County Wicklow has served ten years of a 15 year sentence, for the rape of a young woman in Carlow.
It is understood he did not undergo treatment for sex offenders while in prison.
The 45-year-old has been questioned in connection with the disappearance of a number of women in the Leinster area in the 1990's.
