How To Transfer Ownership Of A Trademark?
Trademarks are transferable, just like any other piece of property, but how do you transfer them?
We transfer a trademark via a document called an Assignment that is filed with the United States Patent and Trademark Office.
It's important to make this transfer "official" even if you have a signed transfer document, because it puts everyone on notice of your trademark rights. It also gives the Trademark Office an address of record for them to send you any correspondence about your trademark renewal or any liigation filed with the Trademark Trial and Appeal Board such as any cancellation proceedings. If the USPTO does not have the proper correspondence address for the trademark owner, notification for things like a pending cancellation proceeding may not reach you, and you may inadvertently lose your trademark rights because you didn't respond to a Petition for Cancellation. So be sure to keep your address up to date with the United States Patent and Trademark Office.
