Описание: Addressing a programme "India and the Living Indian Constitution at 75 Years", Justice Gavai opined that children of an IAS officer can not be equated with the offsprings of a poor agricultural labourer when it comes to reservations.

"I also went further and took a view that the concept of creamy layer, as has been found in the judgment of Indra Sawhney (vs Union of India & Others). What is applicable to the Other Backward Classes, should also be made applicable to Scheduled Castes, though my judgment has been widely criticised on that issue," Justice Gavai said.

"But I still hold that judges are not supposed to normally justify their judgments, and I still have about a week to go [retirement]," Justice Gavai further said.

The CJI said over the years, equality or women empowerment is gaining momentum in the country and the the discrimination which was meted out to them was strongly criticised.

He said before he is set to end his journey as the Chief Justice in a couple of days, the last function that he attended happened to be again at Amaravati of Andhra Pradesh while the first one after becoming the CJI was at his native place Amravati in Maharashtra.

Justice Gavai observed in 2024 that states must evolve a policy for identifying the creamy layer even among the Scheduled Castes (SC) and Schedule Tribes (ST) and deny them the benefit of reservation.

न्यायमूर्ति गवई ने कहा, "मैं आगे बढ़ा और यह विचार भी रखा कि क्रीमी लेयर की अवधारणा, जैसा कि इंदिरा साहनी (बनाम भारत संघ और अन्य) के फैसले में पाया गया है, जो अन्य पिछड़ा वर्ग (OBC) पर लागू है, उसे अनुसूचित जातियों (SC) पर भी लागू किया जाना चाहिए, हालांकि इस मुद्दे पर मेरे फैसले की व्यापक आलोचना हुई है।"

न्यायमूर्ति गवई ने आगे कहा, "लेकिन मैं अब भी मानता हूं कि न्यायाधीशों को सामान्य तौर पर अपने फैसलों को सही ठहराने की जरूरत नहीं होती है, और मेरे पास अभी भी (सेवानिवृत्ति के लिए) लगभग एक सप्ताह बाकी है।"

मुख्य न्यायाधीश ने कहा कि पिछले कुछ वर्षों में, देश में समानता या महिला सशक्तिकरण गति पकड़ रहा है और उनके साथ होने वाले भेदभाव की कड़ी आलोचना की गई।

उन्होंने कहा कि चीफ जस्टिस के रूप में अपनी यात्रा समाप्त करने से कुछ दिन पहले, वह जिस आखिरी कार्यक्रम में शामिल हुए, वह आंध्र प्रदेश के अमरावती में था, जबकि CJI बनने के बाद पहला कार्यक्रम उनके गृहनगर महाराष्ट्र के अमरावती में था।

न्यायमूर्ति गवई ने 2024 में टिप्पणी की थी कि राज्यों को अनुसूचित जाति (SC) और अनुसूचित जनजाति (ST) के बीच भी क्रीमी लेयर की पहचान करने और उन्हें आरक्षण के लाभ से वंचित करने के लिए एक नीति विकसित करनी चाहिए।
