In this video, I'll provide an overview of 8 crucial H-2B rules that employers need to know and understand now that your workers have arrived and begun working.
1. Paying Wages for H-2B and Corresponding U.S. Workers
Ensure you're paying your H-2B workers and corresponding U.S. workers correctly. If you have different wages, ensure there's a legitimate reason, ideally mentioned in your approved H-2B paperwork.

2. Record Keeping
Maintain all pay statements for your workers throughout the H-2B season, from their arrival to their departure, for at least 3 years.
3. Reporting Terminations and Departures
Report any H-2B worker terminations or job abandonment to the DOL and USCIS within 2 business days.

4. Recruitment Records
Keep the H-2B recruitment report, resumes from U.S. applicants, advertising, and contact evidence for three years.

6. Worker Notification to Leave the U.S.
Inform your H-2B workers in writing that they must leave the U.S. at the end of the season. Use an attestation form for their confirmation.
7. Display DOL Worker Rights Posters
Display H-2B Worker Rights posters at the worksite and keep photographic evidence and signed statements confirming they were up for the entire season.
8. I-9 Employment Eligibility Compliance
Complete Form I-9 for each H-2B worker, verifying their employment authorization with acceptable documents like their visa, passport, and I-94 print-off.
