Описание: On 14th January, the Calcutta High Court witnessed a sharp legal face-off between the Enforcement Directorate and the Trinamool Congress leadership.
Arguing for the ED, Additional Solicitor General S.V. Raju strongly defended the agency’s actions, stating that the investigation was lawful, evidence-based, and well within the statutory powers of the ED under PMLA. He rejected allegations of political vendetta, stressing that courts cannot interfere at the investigative stage when material indicating proceeds of crime exists. Raju emphasized that constitutional functionaries are not immune from investigation, and rule of law applies equally to all.
On the other side, Senior Advocate Menaka Guruswamy, appearing for the TMC side, mounted a constitutional challenge. She argued that the ED’s actions reflected selective targeting and misuse of central agencies, warning that criminal law cannot be weaponised to settle political scores. Guruswamy highlighted issues of procedural fairness, proportionality, and federal balance, asserting that unchecked investigative power threatens democratic values.
The hearing underscored a larger constitutional conflict—agency power versus political freedom—with the High Court closely scrutinising both authority and intent.
