In 1995, three kids from Newcastle, Australia were suddenly on top of the world. Their debut album, Frogstomp, had turned them into global rockstars almost overnight. They were still teenagers, but fame casts a long shadow. As the album climbed the charts, one song began to take on a life of its own. Within a year, lyrics written by a teenage Daniel Johns would be read aloud not in a mosh pit, but in a U.S. courtroom. A song designed to condemn violence was about to be twisted into a key exhibit in a murder defense.

In 1992, school friends Daniel Johns, Ben Gillies, and Chris Joannou started jamming in Newcastle as Innocent Criminals. Grunge ruled the early ’90s, and bands like Nirvana and Pearl Jam seeped into that suburban garage. In 1994, now renamed Silverchair, they sent their song “Tomorrow” to a TV and radio competition—and won. At 15, they scored a professional recording session and a Sony deal. “Tomorrow” exploded, spending six weeks at number one in Australia. Critics compared them to Nirvana, but there was a ferocious musicality that was uniquely theirs, made even more shocking by the fact it was coming from literal kids.
With “Tomorrow” blowing up, Silverchair raced into the studio. They recorded Frogstomp in just nine days. Released in 1995, it debuted at number one in Australia and sold over 2 million copies in the U.S. Driven by singles like “Tomorrow,” “Pure Massacre,” and “Israel’s Son,” it was an unfiltered blast of teenage angst. On tour, the energy could turn dangerous. At one show in 1995, while playing “Israel’s Son,” Johns was hit in the head by a bottle and needed six stitches—an ugly snapshot of the chaos surrounding the band.
Frogstomp opens with heavy drums, sludgy bass, and a monstrous riff: “Israel’s Son.” The lyrics push it into darker territory. Lines like “Hate is what I feel for you / I want you to know that I want you dead,” and “If you’re not here soon I’ll finish your friend instead,” sound like pure menace taken at face value. But Johns later explained the song came from a nightmare after watching a TV documentary about wartime executions. It wasn’t a revenge fantasy; it was meant to portray the horror of violence, a character study in hatred meant to condemn it.
In McCleary, Washington, 16‑year‑old Brian Bassett spiraled from star athlete to troubled runaway. On August 10, 1995, Bassett and his 17‑year‑old boyfriend, Nicholaus McDonald, murdered Bassett’s parents and his five‑year‑old brother while plotting to steal money and a car to run to California. Arrested and tried as adults, they faced trial in January 1996.
That’s where Silverchair were dragged in. McDonald’s lawyer claimed the pair were listening to Frogstomp and tried to introduce “Israel’s Son” as evidence, calling the lyrics “almost a script” for the killings. Prosecutors pushed back, arguing the song was a scapegoat for a planned robbery‑murder. The jury agreed. Bassett received three life terms without parole, and McDonald was sentenced to 65 years.
From Australia, Silverchair—still only 16—were horrified. Their manager, John Watson, issued a statement: the band did not and would never condone violence, and “Israel’s Son” was written to criticize war by showing its horror. Legally, they were cleared. Emotionally, it wasn’t so simple. Years later, Daniel Johns admitted the case was devastating, saying it was “too much” to have a teenage song linked to murder.
