hi I'm Brandon Naidoo I'm a criminal defense attorney here in San Diego California purpose of this video is I want to talk to you about concealed carrying of a firearm in California specifically in San Diego if you've been paying attention to the news in the last year and a half or so there was a major Supreme Court decision that came down that effectively invalidated many of the country's concealed carry laws and it's created this ambiguity as to what is the status of concealed carrying permits in the state of California so the case in question is what's known as the Bruin case in that case stemmed originally out of the state of New York so the laws that were invalidated by that Supreme Court decision were the state of New York but presumptively had an effect on all 50 States including California the issue is is that as any time a Supreme Court decision comes down and invalidates a lot of state laws the states tend to fight back and that's what California is doing California is not ready to just roll over and say that they're going to get rid of their concealed carry permit laws at this time so they're challenging they're saying that the Supreme Court decision doesn't necessarily apply to them because their laws are markedly different than the New York laws that were struck down and we don't have a California Supreme Court case or a major appellate decision yet in California that is invalidating those laws so as it stands right now concealed carry of a firearm in the state of California still requires a permit most counties are still May issue instead of shall issue which means which is what the Supreme Court says that these states shall issue these permits provided that the person seeking the permit is a lawful possessor of a firearm their second amendment rights have not been Stripped Away by a felony conviction domestic violence something of that nature drug addiction Etc so if you are planning on concealed caring in California you need to currently still go through the proper channels and obtain a permit failure to do so and carrying a 5 firearm concealed on your person is still a crime in California unfortunately we've had many clients who have come to us who have said I thought I was protected of the Supreme Court decision but now I'm being charged with a crime we've had to have this unpleasant conversation with them so this is something that a lot of people don't know yet is that they still need to comply with California's concealed carry laws with regards to Firearms at this time if you have any further questions or if you have been charged with concealed carry of a firearm please give us a call area code 619-577-0868
