In this video, attorney Joseph Scrofano explains several important things to understand if you receive a subpoena to testify before a DC grand jury. Prosecutors will convene a grand jury in felony cases in the District of Columbia because the law requires that they indict someone to charge them with a felony. An indictment is the formal charging document and often contains multiple serious charges. Grand jurors are members of the community who get summoned for grand jury duty much like regular jury duty. However, grand jury proceedings are held in secret. The target of the investigation is not entitled to a defense and even a material witness lawyer is not permitted to appear with their client when they testify.

In the District of Columbia, its important to understand what rights you have if you receive a subpoena to testify before a DC grand jury. First, you have a right to an attorney and if you cannot afford one the court will provide you with one. Second, you have a right to know what the grand jury is investigating. Finally, you have a right against self-incrimination. That means if testifying in front of the grand jury would require you to disclose incriminating information about yourself under oath, you may be able to plead the Fifth.
