Senate acceptance of Guteza's oral testimony won't erase liability - expert | DZMM TeleRadyo

Even if the Senate accepts his oral testimony, surprise witness Orly Guteza is still liable for perjury and falsification of a public document if proven that he presented an affidavit with a fake signature, the former president of the Philippine Bar Association said Wednesday.
Atty. Rico Domingo, who is also chairman of the Movement Against Disinformation, said Guteza’s affidavit is already inadmissible as evidence if proven that the notary’s signature was forged and the affidavit’s creation not in accordance with the Notarial Act.
Domingo said the Senate Blue Ribbon Committee can still choose to assess the truthfulness or falsity of Guteza’s testimony independent of the affidavit but noted this will not erase the latter from liability.
He said those who presented the affidavit could also be held liable “if they knew that it was forged, its contents fabricated and that there are perjurious statements within.”
