Youth Court Bail Hearing

Описание: The Bail Act 1985 allows the Youth Court to hear bail applications from a young person who has been arrested and charged with the suspicion of having committed an offence in respect of which he or she has been taken into custody or has been released on police bail and is to return to the Court at later date.
A private lawyer, duty solicitor from the Legal Services Commission (LSC), or a legal representative from the Aboriginal Legal Rights Movement (ALRM) can represent the young person and make an application to the Court for bail.
A young person can agree to enter into a bail agreement under which that person makes an undertaking to the Crown. The person is subject to any direction in the agreement throughout the proceedings and must comply with any conditions as to the person’s conduct while on bail as stipulated in the agreement.
If the young person fails to comply with a condition of the bail agreement, without proper excuse, the person can be arrested and taken into custody to appear before the Court and may forfeit to the Crown a sum stipulated in the agreement.
The Youth Court can vary the conditions or revoke the bail agreement on application of the young person or their legal representative.
