Army general represented by 'pencil box lawyer' in RM5mil CBT case

Описание: Datuk Ahmad Zaharil Muhaiyar, popularly known as the "pencil box lawyer", is leading the defence team for Major General Datuk Mohamed Fauzi Kamis in his RM5 million criminal breach of trust (CBT) case.

Fauzi, who is the chief of staff of the Armed Forces' Joint Forces Headquarters, pleaded not guilty to the charge in the Sessions Court.

He is alleged, in his capacity as assistant chief of staff for personnel services and chairman of the Armed Forces Welfare Fund (TKAT) investment committee, to have made an additional investment in a company without the committee's approval.

The offence, under Section 409 of the Penal Code, was allegedly committed at the Defence Ministry on Nov 27, 2023.

Deputy public prosecutor Law Chin How proposed bail at RM300,000 with one surety and requested that the accused surrender his passport.

Zaharil appealed for minimum bail, citing that his client has three children who are still in school, and said Fauzi was prepared to surrender his passport to the court.

The court set bail at RM100,000 with one surety and imposed the additional conditions requested by the prosecution. The case has been fixed for mention on March 16.
