Описание: The Supreme Court has questioned a January 2026 judgment that denied bail to Umar Khalid and Sharjeel Imam in connection with the 2020 Delhi riots case. The court observed that both have spent over five years in jail while the trial has still not begun. Referring to earlier rulings, the bench noted that prolonged detention can be a valid ground for granting bail. The court also reiterated the principle that “bail is the rule, jail is the exception,” while granting bail to Jammu and Kashmir narco-terror accused Syed Iftikhar Andrabi. The bench stressed that smaller benches cannot override judgments delivered by larger benches and expressed disapproval over the earlier order denying bail to Umar Khalid and Sharjeel Imam.
