California’s Elderly Parole Program is facing renewed scrutiny after the Board of Parole Hearings granted parole to David Allen Funston, a Sacramento man convicted in the 1990s of kidnapping and sexually molesting multiple children. Funston, now 64, was sentenced in 1999 to 20 years and eight months, along with three consecutive terms of 25 years to life. However, under the Elderly Parole Program established in 2017, inmates who meet age and time-served requirements can become eligible for parole. A 2020 law expanded eligibility to inmates age 50 who have served at least 20 years. Funston, now 64 and having served nearly 27 years, qualifies under either standard.
