Judge Mogen's Stunning Revelation: Plea Deal Takes a Surprising Turn!
In State of Wisconsin v. Andrew Koti, the court convened for what was supposed to be a plea and sentencing hearing. The prosecution and defense had reached a deal: Koti would plead guilty to one count of misdemeanor disorderly conduct, with other charges dismissed and read in, and both sides recommending court costs only ($443). Koti was already revoked in Polk County for substance-related offenses and expected to face sentencing there.
However, everything changed when the victim, S.B., delivered a powerful and emotional statement. She recounted nearly a year of physical and emotional abuse by Koti — being hit, spat on, called names, having her phone ripped apart, and her head bashed against a car window. She described lasting trauma, nightmares, panic attacks, and ongoing therapy. She pleaded for jail time, no contact, probation, and treatment, saying it wasn’t fair for him to “get away scot-free.”
The judge was visibly disturbed, noting that none of this information appeared in the criminal complaint, which described only a “minor argument.” The prosecutor admitted the state was unaware of the full extent of the violence when the plea was negotiated. The judge questioned why battery charges were never filed and emphasized that the case details now painted a very different picture.
When questioned, Koti denied fighting or provoking a disturbance, contradicting both his guilty plea and the victim’s detailed testimony. That prompted the judge to reject the plea deal outright, declaring, “Good. We’re going to trial.” The case was set for June 24th, with a final plea deadline of May 19th. The judge stated bluntly that a plea deal involving “costs only” was not in the public interest, given the gravity of the victim’s allegations.
