What is Cerebral Palsy, what are the signs, what is the impact and how can it happen?
A baby might suffer with Cerebral Palsy as a result of oxygen deprivation during birth, where the brain is starved of oxygen. This can be caused in several ways, such as shoulder dystocia, where the shoulder gets stuck during the labour process, or the umbilical cord being wrapped around the baby’s neck.
Initially you could see warning signs such as the baby having seizures. As the baby gets a little bit older they might not meet their developmental milestones.
How is Cerebral Palsy diagnosed?
A doctor might say they are concerned about a particular aspect of the baby’s development.
Although you may recognise that your birth experience was difficult or traumatic, it is not always immediately obvious that harm was caused to the baby. Most of the time babies are born without complications. However, with Cerebral Palsy, it can take days, weeks, months or even years before it is apparent that the baby has suffered harm and a formal diagnosis of Cerebral Palsy is made.
What sort of compensation can I expect from a Cerebral Palsy medical negligence claim and how is it calculated?
Compensation covers the pain and injuries that the child has experienced, which will depend on the severity of that injury. In addition, there is compensation for the financial losses incurred, both past and future.
There may be a need for different accommodation, or adaptations to an existing home. There may be a need for lifelong care if the disability is quite significant. There might be occupational therapy, speech and language therapy, physiotherapy. These would be dealt with by experts in their fields who come in, carry out assessments, and provide Gadsby Wicks with the evidence needed to advise you properly on the compensation that should be recovered.
Do I have to pay upfront to make a medical negligence claim for Cerebral Palsy?
People are often very concerned about how they are going to fund their medical negligence claim, particularly for Cerebral Palsy. What we offer is a true no win, no fee agreement. If the claim is not successful, we will not take any money from you. If the claim is successful, you will almost always retain all of the compensation that has been recovered for the benefit of the child for the rest of their lives.
How long does a Cerebral Palsy medical negligence claim take to conclude?
A claim for Cerebral Palsy generally takes a while to bring to conclusion. There is a significant amount of evidence that needs to be gathered to deal with and address all necessary issues. We have to get both medical and sometimes non-medical experts to ensure everything has been addressed properly.
We also have to be very aware that, as children grow and develop, additional problems can come to light. We want to make sure that at the point of settlement, we are as confident as possible of what the future holds for that child. That often means Cerebral Palsy claims aren't settled until the child is at least 10 or 11, when all likely complications will be apparent.
