This is Lecture 2 of the Hindu Marriage Act, 1955 lecture series on our channel, specially designed for Judiciary Aspirants and Law Students.
In this lecture, we have discussed Section 1 of the Hindu Marriage Act, focusing on the territorial extent of the Act and its extra-territorial application.
The lecture explains how earlier High Courts interpreted Section 1 and Section 2 of HMA along with Article 245(2) of the Indian Constitution to hold that the Act can have extra-territorial operation even without territorial nexus.
Further, the lecture covers the landmark judgment of Sondur Gopal v. Sondur Rajini, where the Supreme Court emphasized the importance of the word “domiciled” in Section 1(2) of HMA, and clarified that Hindu Marriage Act will not apply to persons not domiciled in India.
Topics Covered:
• Section 1 Hindu Marriage Act explained
• Territorial extent of HMA, 1955
• Extra-territorial jurisdiction under personal laws
• Article 245(2) Constitution of India
• Combined reading of Section 1 & 2 HMA
• Concept of domicile under Hindu Marriage Act
• Sondur Gopal v. Sondur Rajini case analysis
• Judiciary exam–oriented interpretation
📌 Highly useful for Judicial Services, LLB exams, Family Law & Constitutional Law preparation
