In this video, we dive deep into the Sources of Hindu Law, exploring how a legal system with over 6000 years of history has evolved from divine revelations to modern parliamentary statutes.
The term "source" refers to the foundation upon which law is built. For Hindu Law, this foundation is a unique blend of ancient spiritual wisdom and modern judicial pragmatism. We break down these sources into two major categories:
🏛️ 1. Ancient or Traditional Sources
Learn about the classical roots of Hindu jurisprudence:
Sruti (Vedas): The "paramount" source—divine revelations heard by sages (Rig, Yajur, Sama, and Atharva Veda).
Smritis: The "remembered" laws, including the influential works of Manu, Yajnavalkya, and Narada.
Digests & Commentaries (Nibandhas & Tikas): How scholars like Vijnaneshwara (Mitakshara) and Jimutavahana (Dayabhaga) systematized the law between 700 AD and 1700 AD.
Customs (Achara): The power of long-standing practices. We discuss the landmark case Collector of Madura vs. Muthu Ramalinga, establishing that "clear proof of usage will outweigh the written text."

⚖️ 2. Modern Sources

Justice, Equity, and Good Conscience: Filling the gaps when the law is silent.
Precedent (Judicial Decisions): Understanding "Judge-made law" and the doctrine of stare decisis.
Legislation: The supreme source in the modern era. We cover the four pillars of codified Hindu Law:
The Hindu Marriage Act, 1955
The Hindu Succession Act, 1956
The Hindu Minority and Guardianship Act, 1956
The Hindu Adoptions and Maintenance Act, 1956
